Kapy Notes Terms of Service
These terms cover your use of the Kapy Notes app and this website. They are written to be read, not to be survived.
Who provides Kapy Notes
Kapy Notes is made and published by Kapybara LLC. In these terms, "we" means Kapybara LLC and "you" means the person or organisation using the app. Using Kapy Notes means you accept these terms.
Your notes are yours
You keep every right to what you write. We claim no ownership of, and no license to, your notes. Kapy Notes stores them on your device, and we have no way to read them. You are responsible for keeping your own backups.
Sharing notes with other people
With Pro Lifetime you can share a note with people you invite by email. Sharing is part of sync, so the people you invite need Pro Lifetime to join. A shared space is somewhere other people can read and write, so what goes in one is subject to a short set of rules. By sharing a note, or by joining a space somebody else shared, you agree not to use Kapy Notes to:
- harass, threaten, bully, or impersonate anyone
- send unwanted or repeated invitations to people who do not want them
- share sexual content involving children, or any content that sexualises a minor
- share content that incites violence, or that is illegal where you or the recipient are
- share material you have no right to share
You are responsible for what you put in a shared space and for who you invite into one. If somebody breaks these rules, you can block them and report it from inside the app: block them from the invitation, or from the member list of the space you share with them. Reports go to a person, not a queue, and we aim to answer within two business days.
We can act on a report by removing an account's ability to share, or by closing it. Because shared notes are encrypted and we cannot read them, we can only judge a note's contents if the person reporting chooses to send us a copy; the app asks before it does, and never sends one otherwise. Without that copy we can still act on who did it and on the pattern of behaviour. We may also refuse to relay invitations from an account that repeatedly sends unwanted ones.
Blocking someone stops them inviting you again and takes you out of any space you shared with them. It does not reach back and delete what they have already downloaded, and nothing could: that is true of anything you have ever sent another person.
The Forever Free plan
Forever Free includes every writing and calculation feature, up to five notes, fifteen minutes of cloud transcription each month, and lifetime updates. It costs nothing and does not expire. You can install it on as many devices as you like; each keeps its own notes, because Forever Free does not include sync or sharing.
If you have more than five notes, for example when a Pro trial ends or after a refund, nothing is deleted. The five at the top of your list stay editable, pinned notes first, so pinning a note is how you choose to keep it editable. The rest can still be opened, copied, exported and deleted, but not edited, and a new note can be started once you have fewer than five. Archived notes count toward the five. Notes in a space someone else owns do not.
The Pro trial
Every account starts with fourteen days of everything Pro Lifetime includes, free. We do not ask for payment details to begin it, and nothing is charged when it ends: the account moves to Forever Free on its own. An account created before the trial was offered gets its fourteen days from the first time it is used afterwards. There is one trial per account, and it cannot be paused or restarted.
When the trial ends the account has what Forever Free includes, as described above. Nothing is deleted: your notes stay on every device that already has them, and what was synced stays in your account, so buying Pro Lifetime later picks up where the trial left off. We may change or withdraw the trial for accounts that have not started one.
The Pro Lifetime license
Pro Lifetime is a one-time purchase of $24. It grants you a perpetual, non-exclusive, non-transferable license to use Kapy Notes with unlimited notes and lifetime updates, for personal or business use, on the devices you own or control. Encrypted sync across your devices, and sharing notes with other people, are included.
You can buy Pro Lifetime without an account inside a supported mobile app. Until you sign in it unlocks only the part that works without one, which is writing past the free note limit on that device; sync, sharing, storage and transcription belong to an account and begin when you sign in. Web and desktop checkout ask you to sign in first, so the purchase belongs to that account immediately. A purchase belongs to the first account that claims it: restoring it on a second account does not move it.
The license is not a sale of the software itself. You may not resell, sublicense, rent, or redistribute Kapy Notes or share the account it is granted to, and you may not attempt to work around the plan limits. You may reverse-engineer the app only to the extent your local law allows regardless of this restriction.
Where you bought it
If you bought Kapy Notes through the Apple App Store, Google Play, or another store, that store's terms also apply to your purchase, and its refund process is the one that governs. Apple App Store purchases are additionally covered by Apple's standard Licensed Application End User License Agreement, with Apple entitled to enforce it as a third-party beneficiary. If you bought Pro Lifetime directly from kapynotes.com, RevenueCat hosts the purchase flow and Stripe processes the payment. Their checkout terms apply to the transaction, alongside these terms and our refund policy.
Exchange rates
Currency conversion uses rates from third-party providers, as described in the privacy policy. Rates are provided for convenience, may be delayed or unavailable, and are not financial advice. Do not rely on Kapy Notes for decisions that need an authoritative rate.
Accounts nobody comes back to
If you have an account and do not sign in to it for two years, we may delete it and everything stored under it. We will email the address on the account at least thirty days beforehand. Signing in at any point, during those thirty days or at any time before them, starts the clock again. This applies to Pro Lifetime accounts as well as free ones, because it is about storage we are holding rather than about what you paid.
Notes on your own devices are not affected by any of this. They are files on your machine, they are not ours to delete, and an app with no account never has one to lose. If you want to keep a copy of what is synced, the app can export everything at any time.
Updates and availability
Kapy Notes runs locally, so it keeps working whether or not we publish anything new. We may change, add, or remove features in future versions, and we may stop distributing the app. Versions you have already installed remain yours to keep using.
No warranty
Kapy Notes is provided "as is", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow excluding implied warranties, so this may not apply to you.
Limitation of liability
To the extent the law allows, Kapybara LLC is not liable for indirect, incidental, special, or consequential damages, or for lost data or lost profits, arising from your use of Kapy Notes. Our total liability is limited to the amount you paid us for the app in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.
Governing law and disputes
Kapybara LLC is registered in Wyoming, United States, and operates from Delhi, India. These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Any dispute arising out of or relating to them will be brought exclusively in the courts of New Delhi, India, and both you and Kapybara LLC consent to that venue.
This does not take away rights you have as a consumer under the mandatory law of the country you live in. Where your local law gives you protections that cannot be waived by agreement, or the right to bring a claim in your own courts, those rights continue to apply and nothing here overrides them.
Purchases made through the Apple App Store, Google Play, or another store are also subject to that store's own terms, which set their own governing law and venue for the transaction.
Changes to these terms
If these terms change, this page is updated and the date at the top changes. Continuing to use Kapy Notes after a change means you accept the updated terms.
